01. Acceptance of Terms
By accessing or using the Kitolity website and its tools, you agree to be legally bound by these Terms of Service and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the service. If you use Kitolity on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
02. Eligibility
You must be at least the age of majority in your jurisdiction, or old enough to form a binding contract, to use Kitolity. The service is a general-purpose developer utility and is not directed to children. If you use the service, you confirm you meet these requirements.
03. Your Content & Responsibilities
You retain all ownership of the files and text you process with Kitolity; we claim no rights over your content. You are solely responsible for the content you upload and for keeping your own backups. You represent that you have the necessary rights to the content and that processing it will not infringe any third party's rights or violate any law. Do not upload content that is unlawful, infringing, malware-bearing, or that you are not authorized to process.
04. Acceptable Use
You are granted a non-exclusive, revocable, non-transferable license to use our tools for lawful purposes. You agree not to: use the service to process malicious payloads or infringe others' rights; attempt to breach, disrupt, reverse engineer, or overload our systems or those of our providers; circumvent rate limits or security controls; or use automated means to scrape or resell the service. We may suspend or terminate access for conduct that violates these Terms.
05. Third-Party Services
Some tools rely on third-party sub-processors — including CloudConvert (Lunaweb GmbH), Google Cloud Translation, and Resend — to perform server-side processing. When you use those tools, your use is also subject to the applicable provider's terms and acceptable-use policies, and you agree not to submit content that would violate them. We are not responsible for the acts, omissions, or availability of third-party providers.
06. Donations & Affiliate Links
Kitolity is free to use. You may optionally support us through the "Support Kitolity" link, which directs you to our page on Ko-fi, a third-party platform that processes any voluntary donation under its own terms; donations are voluntary, are non-refundable except where required by law, and confer no additional rights, warranties, or service levels. Some pages may also contain clearly-labelled affiliate links (marked "Affiliate", using rel="sponsored") to relevant third-party products; if you purchase through one, we may earn a commission at no extra cost to you. We do not control and are not responsible for third-party sites, their content, pricing, or policies, and any dealings with them are solely between you and that third party.
07. Kitolity Pro & Pro Max (Subscriptions & Credits)
Kitolity Pro ($6/month) and Pro Max ($8/month) are optional paid subscriptions that add a monthly pool of cloud credits (spent by the PDF and translation tools), larger uploads (up to 100 MB), an ad-free experience, and an exclusive theme. You can also buy one-time cloud-credit top-ups. These are sold by our Merchant of Record, Paddle, which acts as the authorized reseller and handles payment, invoicing, and applicable taxes; your purchase is therefore also subject to Paddle's buyer terms. Subscriptions renew automatically for successive periods at the then-current price until cancelled. You may cancel at any time from your account or the billing portal — cancellation stops future renewals, and your plan remains active until the end of the period already paid for. Prices and applicable taxes are shown at checkout. Refunds are handled in line with our Refund Policy, Paddle's refund policy, and any non-waivable statutory rights you have. We may change the plans' features or pricing on a prospective basis, giving reasonable notice of material changes; your continued subscription after a change constitutes acceptance.
08. Service Availability & Disclaimers
The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that outputs will be accurate for your purpose. We offer no Service Level Agreement for the free tier and may throttle, modify, perform maintenance on, or deprecate tools without prior notice.
09. Intellectual Property
The Kitolity name, visual design, brand assets, and the compiled source code of the interface are our intellectual property or licensed to us, and are protected by applicable law. Except for your own content, you may not copy, redistribute, or commercially exploit our interface or code without our prior written authorization. All rights not expressly granted are reserved.
010. Limitation of Liability
To the maximum extent permitted by law, in no event will Kitolity or its providers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the service. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the service is limited to the greater of the amount you paid us for the service in the preceding twelve months or one hundred (100) US dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
011. Indemnification
You agree to indemnify and hold harmless Kitolity and its operators from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your content, your use of the service, or your violation of these Terms or of any law or third-party right.
012. Governing Law & Disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the competent courts in India for any dispute, except where mandatory local consumer-protection law grants you rights in your own place of residence. Nothing in these Terms limits any non-waivable statutory rights you may have.
013. Changes & Termination
We may update these Terms from time to time; material changes take effect when we update the revision and effective date shown above, and your continued use constitutes acceptance. We may suspend or discontinue the service, in whole or in part, at any time. You may stop using the service at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
